Terms and Conditions of Hotel Szczawnica Park Resort & Spa *****

Subject of the Terms and Conditions

  1. These terms and conditions, hereinafter referred to as the terms and conditions, define the subject of the provision of services, responsibility and rules of staying in Szczawnica Park Hotel in Szczawnica, hereinafter referred to as the Hotel.
  2. Services at the Hotel are provided by HSP Management Sp. z o.o. with its registered office in Szczawnica, ul. Główna 25, 34-460 Szczawnica.
  3. The Terms and conditions are an integral part of the contract, which is concluded by signing the check-in card, as well as by performing concluding actions, in particular by making a reservation and/or payment of a deposit or the entire amount due for the stay in the Hotel.
  4. The Terms and conditions are binding on all persons staying in the Hotel.
  5. The Terms and conditions are available for inspection at the reception desk of the Hotel, in each Hotel room and on the Hotel's website.

General Regulations

  1. The Hotel room is rented for Hotel nights. Check-in time is from 15:00 to 11:00 the next day.
  2. When renting a Hotel room, the Guest shall specify the duration of his/her stay, and in the absence of such a specification, it is assumed that the room was rented for one night.
  3. Wish to extend the stay beyond the period indicated on the day of arrival, the Guest should report it at the reception desk by 10:00 a.m. of the day on which the term of the Hotel room rental expires. The Hotel will grant the request to extend the stay as far as rooms are available.
  4. The Hotel reserves the right to refuse to extend the Guest's stay at the Hotel, in case of failure to make prior full payment for the current period of stay and in case of failure to comply with the Rules.
  5. Unjustified detention of the room after 11:00 a.m. may be treated as an extension of the night.
  6. The basis for admission of the Guest to the Hotel, is to complete the Hotel card, including Guest data, completion of a statement on acceptance of the content of the Regulations and signing the Hotel card. A representative of the Hotel at the reception desk may verify the Guest's identity document in order to confirm identity
  7. The Guest agrees not to exceed the number of people staying in the room with him/her beyond that specified in the booking confirmation. In case of exceeding this number of persons, the Hotel will charge a fee for additional persons.
  8. Persons visiting the Guests of the Hotel may stay at the Hotel from 7:00 a.m. to 10:00 p.m. Outside of the designated hours, staying at the Hotel, including in the Hotel room of another Guest, requires a fee. The Hotel will require payment of a Hotel stay and completion of formalities indicated in para. 6 above.
  9. The stay of children under 3 years of age in the Hotel is free of charge. At the request of the customer, the Hotel provides a crib to the room for an additional fee. The Hotel has a limited number of cribs, so a crib will be lent upon availability.
  10. The Hotel accepts the stay of pets. An additional fee is charged for the stay of a pet. The Guest bears full responsibility for the animal and any damage caused by it.
  11. The Hotel may refuse to accommodate a Guest who, during the previous stay severely violated the terms and conditions in particular by causing damage to Hotel or other Guests’ property, damage to other Guests, Hotel employees or other persons staying at the Hotel.
  12. The Hotel reserves the right to block or charge funds on the credit card provided by Guests, for the purpose of confirming a reservation, in the amount due for part or entire stay, whereby the Guest hereby authorizes a representative of the Hotel to perform the action of charging the card the action of collecting the amount due from the card.
  13. The Hotel reserves the right to withdraw funds from the credit card provided by the Guest in case of non-payment of the bill for services after departure.
  14. If the balance on the Guest's account exceeds PLN 10,000, the Guest will be obliged to settle it on the day the overdrawn balance arose otherwise further stay of the Guest will be impossible.
  15. In the event of cancellation of a Guest's stay during the course of the day, the Hotel will not refund the fee for the started Hotel day. For shortening the stay, the Hotel Guest will be charged an amount equal to 50% of the value of unused Hotel nights.
  16. The cost of the stay does not include the local tourist tax. The fee should be paid in cash at the reception.
  17. It is forbidden to take food out of the restaurant.
  18. There are designated parking spaces on the premises. Parking outside of the designated places is prohibited. Parking is charged extra in accordance with the applicable price list.
  19. There is internal and external video surveillance on the premises of the Hotel. Any damages involving cars in parking lot should be reported immediately to the reception desk in order to secure records of external monitoring.
  20. The Guest agrees to issue a VAT invoice without signature.
  21. It is prohibited to consume your own alcohol in all catering outlets located within the Szczawnica Park Resort.

Duties and Responsibilities of Guests

  1. The Guest is obliged to always secure the room in case of leaving it by closing the windows and the entrance door and taking careful care of the magnetic card to the room.
  2. The Guest bears material responsibility for any kind of damage or damage to objects, equipment and technical devices of the Hotel arising from his fault or due to the fault of persons (children) and animals under his care and his visitors. The Hotel reserves the right to charge the Guest's credit card for damage caused after his departure. In view of the above, the Guest hereby authorizes a member of the Hotel reception to perform the action of charging the Guest’s credit card.
  3. The Hotel has a statutory right of lien on the items brought by the Guest to the Hotel in the event of the Guest's delay in paying for the stay or failure to pay for the services provided.
  4. The Hotel’s quiet hours must be obeyed daily from 10:00 p.m. to 7:00 a.m. the following day. Guests will not be admitted if they are intoxicated, or their behavior disturbs the peace of others.
  5. The Hotel is entitled to immediately terminate the contract for the provision of Hotel services with Guest who grossly violate the Hotel terms and conditions or disturb the peace of others with their behavior. In such case, the Guest shall be obliged to cover all costs associated with his/her previous stay at the Hotel, including the fee for the started Hotel night.
  6. On the premises of the Hotel, including in areas designated for play, children should be under the constant supervision of Guests or other adults designated by the Guests to take care of the children. The Hotel staff does not accept responsibility for supervision of children staying at the Hotel.
  7. Smoking is strictly prohibited in the Hotel. Guests disobeying the ban will be charged 200 PLN for refreshing of the room.
  8. The Guest agrees to use the room in accordance with its purpose. Apart from slight rearrangement of furniture and equipment that does not affect their functionality and safety of use, Guests are not allowed to make any changes in the rooms and their equipment.
  9. Hotel Guests are not allowed to use equipment and objects that may cause risk associated with damage to Hotel property and other Guests, in particular devices that may cause fire or flooding. It is permissible to use kettles and other devices that are part of the equipment of the rooms. The Hotel Guest will be charged with costs incurred by the Hotel for unjustified activation of the fire alarm and arrival of the Fire Department.
  10. . It is prohibited to conduct canvassing and door-to-door sales in the Hotel, as well as gambling activities
  11. Storing dangerous cargo, weapons, ammunition, flammable, explosive or illuminating materials in the rooms is prohibited.
  12. The organization of social events in the Hotel room is prohibited. For organizing a social event that is disruptive to other Guests or neighbors, the Hotel may charge an additional fee of 500 PLN.
  13. In case of loss of magnetic cards, the Guest shall be obliged to pay a PLN 50 fee for the issuance of a new card for the room.

Duties and Responsibilities of the Hotel

  1. The Hotel shall provide services in accordance with its category and standard.
  2. Liability for loss of or damage of items brought in by persons using the Hotel's services are governed by the provisions of Articles 846-849 of the Civil Code. Hotel’s liability for loss of or damage to a Guest's belongings is limited by law if such items (including, but not limited to, money, securities and other valuable items, in particular valuables and items of scientific or artistic value) are not are deposited at the Hotel reception.
  3. The Hotel reserves the right to refuse to accept items for Hotel deposit if they threaten security or if, in relation to the or standard of the Hotel have too high a value or if they take up too much space.
  4. The Hotel is not responsible for damage and loss of a car or other vehicle belonging to the Guest, objects left in it and live animals, regardless of whether the vehicle was parked in the Hotel parking lot or outside of the Hotel premises.
  5. In the event that an item of personal property is found left behind by a departing Guest in the Hotel room, the Hotel shall notify the Guest and request the collection of the item. The Hotel may, at the request of the Guest, send the item back to the address indicated by the Guest at the Guest's expense. If such instruction is not received, the Hotel will store the items left behid at the owner's expense for a period of one year from the date of the summons, and after expiration of this period the items become the property of the Hotel. Due to their characteristics, food items will be stored for a period of 24 hours.
  6. The Hotel reserves the possibility in exceptional situations (breakdown in the room or other fortuitous event) to provide an alternate premises with parameters and area similar to the reserved room.

 

Complaints

1. Notwithstanding and without affecting the rights provided for by generally applicable law, Guests have the right to lodge a complaint if they notice any deficiencies in the quality of the services provided.

2. The complaint should be submitted to the reception immediately after noticing the deficiencies, which will enable the staff to improve the standard of services provided, or sent by registered mail to the address of the Hotel immediately after the end of the stay.

3. A properly submitted complaint should include the following data:

  • Guest's data and room number if the complaint concerns a room,
  • the subject of the complaint and the demand covered by the complaint,
  • circumstances justifying the complaint.

 

4. If the Hotel does not promptly remove the objections reported by the Guest, the Hotel shall within 30 (thirty) calendar days from the date the Guest reports the complaint respond to the complaint and notify the Guest on how to proceed.

5. In addition, the Hotel shall inform the Guest of the possibility of seeking the assistance of a municipal or district consumer advocate, provincial inspectorates of the Commercial Inspection or one of the social organizations whose statutory tasks include consumer protection, e.g. Federation of Consumers. 6. At http://ec.europa.eu/consumers/odr/ there is a platform for an online system for resolving disputes between consumers and businesses at the EU level (ODR platform). The ODR platform is an interactive and multilingual website with a onestop shop for consumers and businesses seeking out-of-court dispute resolution of contractual obligations arising from an online sales or service contract.
